  1. The following terms and conditions are intended to govern our relationship with you. We have attempted to insure that the following terms and conditions are written in plain English in order to assist you in your understanding of our obligations and yours What is contained in here is important and in order for you to access our services you are required to accept all of the conditions. If you do not agree with these terms and conditions, you may not use or access our games, products, offerings and services (“Products and Services”).

  2. General

    This Agreement contains the terms and conditions that apply to an individual's or entity's access and/or use of Interactive Systems Inc's wagering Products and Services which are accessible at www.sportsbetting.com, www.win4real.com, www.racebook.com or the play–for–fun Products and Services which are available at their “.net” equivalents (the “Sites” or individually a “Site”). Other terms and conditions and/or rules specific to an individual game, contest or wager may apply and you must familiarize yourself with all such terms and conditions and/or rules prior to participation. Your participation in an individual game, contest or wager shall signify your agreement to all applicable terms and conditions and/or rules. If you are only accessing the play for fun offering of a Site then the wagering specific terms herein do not apply to you. If you subsequently access the wagering portion of a Site and wager, then all of the terms herein are applicable to you.

    As used in this Agreement, "we" and “our” and “us” means Interactive Systems Inc. and "you" and “your” means the applicant.

  3. Prohibition

    You can only use our Products and Services on a Site if it is in fact legal for you to do so as determined by the laws of the country, state or territory in which you live and/or access the Products and Services (the “Local Jurisdiction”). We do not intend that anyone should access our Sites or use our Products and Services where such access and/or use is prohibited by applicable law. The availability of our Products and Services and our Sites does not constitute an offer or invitation by us to access the Products and Services from any Local Jurisdiction in which such access is prohibited by applicable law. Your access to our Sites and use of our Products and Services is void wherever prohibited by any applicable law. You accept sole responsibility for determining whether your access to our Sites and/or use of our Products and Services is legal in the Local Jurisdiction. If your use of our Products and Services is prohibited by law in the jurisdiction from which you are accessing a Site or using a Product you will not be entitled to collect any winnings and we reserve the right to 1) cancel your account without notice and 2) void all transactions you have made with us and refund your initial deposit back to you.

  4. Restricted Individuals

    If we consider you to be a Restricted Individual, you are not permitted to register with us or to access our Sites or use our Products and Services. If you circumvent our controls and do open an account with us, we reserve the right to 1) cancel your account without notice and 2) void all transactions you have made with us and refund your initial deposit back to you.

    We consider you a Restricted Individual if:

    1. you are under 18 years of age; or
    2. you are an employee of Interactive System Inc. or its affiliates or a member of the same household; or
    3. your access to our Sites or use of our Products and Services would be prohibited by law as set out in Section 2 Prohibition above; or
    4. you have been banned for any reason by any government licensed land or internet–based casino or sports betting facility located anywhere in the world; or
    5. you are a bookmaker or an employee of a bookmaker using our Products and Services in the course of your employment; or
    6. you are a member of any type of professional gambling partnership or syndicate.


    4. Your Deposits
    Any approved and unutilized deposits in your account will remain in your account balance, except if funds are disputed, in which case you will be held responsible for both, the deposit amount, as well as any fees and/or charges involved. It is your responsibility to contact our Customer Service Department in order to review any discrepancies with their balance and/or deposit records. You are compelled to provide us, within 2 calendar weeks starting from our request, with any and all documents that we deem necessary to proceed with an investigation, related to a claim. In the event the documentation provided by you is misleading, incomplete and/or inaccurate and/or not provided within the abovementioned term, we will be under no obligation to process such claim.

    Before making a deposit and to avoid unnecessary delays in processing your payouts, please make sure your address is correct and that it corresponds to your billing address on your bank records. Depositing with a credit, debit, check, prepaid, gift and/or virtual cards, you agree to provide us with required security information and to keep an updated and complete credit card file. This will include the following:

    In the event that we are not able to verify your account information you may be required to submit additional documentation for this purpose. We reserves the right to request new and updated documentation at any time.

    You are advised that any fees applied by the bank or card company to our charges are the your sole responsibility and will not be reimbursed and/or covered by us in any way. These fees include, but are but not limited to: international charge fee, cash advance fee, or overdraft fee.

  5. License

    We operate our Sites and Products and Services under license from the government of the Netherlands Antilles. Our license permits us to make available our Sites, offer our Products and Services for use and to accept wagers from an international audience. You agree that your access to our Sites, use of our Products and Services and all wagers made by you and subsequently accepted by us occur in the Netherlands Antilles. We make no representation about the legality of our Products AND SERVICES in any Local Jurisdiction.

  6. License Agreement

    We grant you a non–exclusive and royalty–free license to access the Sites and to utilize the Products and Services therein. You agree not to use any of our names, logos, trademarks or service marks for commercial use. Our Products and Services and software are protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. All rights granted herein are licensed, not sold.

  7. General Sports Wagering Rules

    Once we accept your bet you cannot cancel or amend that bet in any way.

    We will make every effort to ensure that all information available on our Site is accurate; however, in the case of obvious mechanical, technical or human error in the prices or conditions we publish, we reserve the right, at our discretion, to either modify your wager and to pay you out at the correct prices or to no-action your wager.

    Unless the rules applicable to a wager require otherwise, you must place your bet and we must accept that bet before the start of the game or event wagered on. Any bet placed or received after the start of the game or event wagered will be void.

    We will not honor any wager you claim has been placed unless that wager is listed in your pending or scored history sheet.

    We reserve the right to suspend or withdraw any game at our absolute discretion and we also reserve the right to refuse or limit any wager.

    We accept no responsibility for the cancellation of any game for any reason.

    Without prejudice to limits placed on player winnings hereafter, the maximum aggregate payout for all wagers taken on any Parlay Card or Teaser Card from all our patrons combined is Seventy-Five Thousand Dollars United States Currency (US $75,000) plus twice the total amount wagered on that particular card. This aggregate payoff shall be paid in proportion to the amount won by all patrons at all Sites where we offer our Products and Services and shall be calculated without regard to the number of propositions selected.

    Members are not permitted to open multiple accounts (either within SPORTSBETTING.COM itself or affiliated websites) in order to circumvent the limits imposed by our wagering system. Performing such an action may trigger an audit of the member's accounts. If multiple accounts have been used then all bets may be voided, accounts may be inactivated and winnings may be forfeited. This also counts for family members in the same household (or physical address) or Non Family Members of the same household (or physical address). No exceptions.

    Where not specified herein, our rules specific to sports wagering can be found in our Sports Betting Rules and Definitions section.

  8. General Racing Rules

    Once we accept your bet you cannot cancel or amend that bet in any way.

    We will not honor any wager you claim has been placed unless that wager is listed in the View Account section of our racing interface.

    We do not accept past–post wagers. Any bet placed by you, or received or accepted by us after post–time will be void. The minimum bet we accept is $1. The maximum bet we accept on all bet types, except Show, is $1,000. The maximum Show bet we accept is $500. We pay full–track–odds on Win, Place and Show bets; we limit all other bet types to track odds with a maximum payout of 300 to 1. The maximum total bet value we will accept on any single ticket is $20,000. We do not offer house odds; if the track does not pay out on a certain type of wager, all wagers of that type will be refunded.

    If a horse is scratched, we will refund all Win, Place and Show bets and the portion of Exacta, Trifecta, Superfecta and Quinella combos that contain the scratched horse. For Daily Doubles, if a horse is scratched before the 2nd leg, a consolation may be paid on that combo, as indicated by the track payout.

  9. Special Tracks Rule

    All PK3 and PK4 tickets are paid out based on the official race results as published by the host track at which the race was run. There are no automated refunds of PK3 and PK4 ticket parts when any runner scratches. Normally, scratched runners are included with the winning runner IF the post time favorite wins the race.

    In the event a scratched entry is not included with a winning post time favorite in the official track results, and the other runners selected for each leg on the ticket are winners, please contact HB Customer Service and the ticket part will be refunded by Customer Service.

    HB reserves the right to refund PK3 and PK4 tickets where a scratched runner is selected for a leg of the ticket after the scratch has been posted by the host track, but before the scratch has been entered in the Racebook. If any such refunds are made, HB Customer Service will notify our client before race time advising of the refund

    Daily Double Grading and Payout Rules

    All Daily Double tickets are paid out based on the official race results as published by the host track at which the race was run.

    Daily Double tickets are automatically refunded where the runner selected in the first leg of a Daily Double is a scratch.

    In the event of a scratch in the second leg of the Daily Double, if the host track pays a Consolation Daily Double (picked the winner of the first leg, but the selection for the second leg is scratched), such winning consolation payment should automatically be paid. If no Consolation Daily Double is paid by the host track, then Daily Double tickets selecting the winner of the first leg and a scratch in the second leg will be automatically refunded.

    If these refunds and payouts do not occur in accordance with these rules, please contact Customer Service for assistance.

    General Horse Racing Interface Rules

    Once we accept your bet you cannot cancel or amend that bet in any way.

    Ticket Pay out Limit Rule

    There is a Cap Payout Limit of $25000 on any Horse racing winning ticket.

    If a horse is scratched, we will refund all Win, Place and Show bets and the portion of Exacta, Trifecta, Superfecta and Quinella combos that contain the scratched horse.

    Special Tracks

    The specific tracks listed below are not normally limited to a maximum payout of 300 to 1. In the event that there are system failures with our racing facilities, we will settle all affected bets at these tracks at track odds with a maximum payout of 300 to 1.

  10. Free Contests

    Prior to your participation in any free contest, you must familiarize yourself with all such terms and conditions and/or rules prior to participation. Your participation shall signify your agreement to all applicable terms and conditions and/or rules of that particular contest.   11. Confidentiality

    We shall undertake to maintain your anonymity unless you agree to your identity being used for publicity or other purposes. Please read our privacy policy for details.

    Not withstanding the foregoing, should you win a casino progressive jackpot in excess of US $25,000 you hereby grant us the right to use your name, likeness, picture, portrait, hometown, voice, biographical information, written submissions and written or oral statements, for advertising and promotional purposes without additional compensation.

  13. Fraudulent Activity

    You acknowledge that any attempt by you, or any party acting upon your explicit or implicit cooperation or encouragement, to defraud us shall result in the forfeiture of your entire account balance including your initial deposit and you shall be permanently banned from further access to our Products and Services. You further acknowledge that this forfeiture shall in no way prevent us from pursuing other avenues of recourse such as the filing of a criminal or civil legal action.

    Without limiting our definition of fraud, we shall consider your activities fraudulent if you place wagers or attempt to place wagers from more than one account, if you place wagers or attempt to place wagers from an account which is not in your own name, if you use the services of a third party to help hide your identity in order to place wagers with us, or if you place wagers or attempt to place wagers through the use of any type of automated device. Furthermore any illegal and/or fraudulent activity identified on any of our games (casino, racing, poker, tournaments, ring games, etc) will incur in a thorough investigation and once completed, we will apply any measures it deems necessary.

    You are also prohibited to use your account and our service in order to transfer funds, pay debts, lend funds, or in any other way send all or part of their balance to another account(s). If this activity is identified we reserve the right to take any and all necessary security measures in all related accounts; these security measures shall include, but are not limited to: voiding balances, cancelling account(s), refunding deposits and requesting full documentation.

    All cards used on an account must be in the name (you) of the account holder member. Use of a third party credit card is not allowed. Basic security information will be required for all cards use. In the event of a lost or stolen card, please contact Customer Service in order to take the necessary security measures.

    Whenever an unauthorized use of a credit or debit card is detected, or if any security related issues are identified in an account, we reserve the right to refund charges, cancel wagers, deactivate the account, and/or request security documentation.

  14. Password

    You are solely responsible for the security of your Personal Identification Number (PIN) and your password. In the event that you suspect that a third party may have your PIN or password, you must ask us to furnish you with a new PIN and password. You are responsible for any unauthorized use of your account. In the event that a third party places a bet or is thought to have placed a bet in your account, said bet shall be valid regardless of whether or not the alleged third party had your prior consent or knowledge. Under no circumstances will any bet be cancelled for this reason.

    When choosing a password we recommend you do NOT use all lower case letters. Do use numbers and symbols. Do use a mix of upper and lower case letters.

  15. Discrepancies/Disputes

    Should there be a discrepancy between the results on your computer and the gaming results on our server, the results on our server shall be determinative, unless we determine an error has occurred with our server.

    After logging in, but prior to placing a wager, you must verify your account balance. When you verify and accept your account balance you agree that all previous transactions are correct and you do not have any claims against us. Claims or disputes against us must be settled prior to you making any further wagers. Notice of these claims or disputes must be reported to us within 3 days from the date of any wager specific dispute.

    If we credit funds to your account in error, it is your responsibility to notify us of the error without delay. Any winnings you achieve subsequent to the error but prior to notifying us, whether linked to the error or not, shall be deemed invalid and returned to us. We reserve the right to adjust your account to correct any error.

    All our Internet transactions will be saved on a tape back–up system. In all cases of dispute, you and we agree that the file tape back-up shall serve as the final authority in the dispute and all wagers and/or account balances will be adjusted accordingly. For disputes, claims, additional account information or to report account discrepancies, contact us by using this form.

    Notwithstanding anything in this Agreement, in the event of any dispute regarding a wager or winnings or any other transaction relating to the use of our Products and Services, our decision will be final and binding in all matters.

    In the event of a discrepancy between the English language version of this Agreement and any other language version, the English language version shall be deemed correct.

  16. Bonuses

    From time to time you may be eligible to receive free bonuses from us. Your eligibility and the amount of these free bonuses shall be subject to our discretion and shall be non–transferable and non–refundable. Bonuses are not cumulative. Therefore, if you make a deposit that is eligible for a bonus under two separate promotions, your account will only be credited with one bonus and the other will not accrue to you.

    You may not request payment of your account balance plus the bonus until you have placed wagers totaling at least three times the amount of the initial deposit plus the bonus. For example, if you open an account and deposit $500 and the deposit bonus applicable to that deposit is $50, you must make wagers totaling $1,650 before you can withdraw your $50 sign-up bonus plus your $500 deposit. (No discussion of rollover for free contests)

  17. Limit of Player Winnings

    The maximum dollar amount that may be won by anyone (whether an individual, corporation or other entity) or any syndicate, partnership or any combination of customers acting in concert in any 30–day period is One Hundred Thousand Dollars United States Currency (US $100,000). This maximum shall apply independently of the number of wagers placed or pending or the amount wagered or pending, and it shall be incumbent upon you to ensure that your 30–day return does not exceed the aforesaid limit.

    In addition to the above, the maximum dollar amount that may be won playing Virtual Derby and / or Super HiLo by any customer (whether an individual, corporation or other entity) or any syndicate, partnership or any combination of customers acting in concert in any 24–hour period is Ten Thousand Dollars United States Currency (US $10,000). This maximum shall apply independently of the number of wagers placed or pending or the amount wagered or pending, and it shall be incumbent upon you to ensure that your 24–hour return does not exceed the aforesaid limit.

    Without limiting the generality of the foregoing, we reserve our right to credit any account or group of accounts controlled by any customer (whether an individual, corporation or other entity) or any syndicate, partnership or any combination of customers acting in concert to a 30–day maximum of One Hundred Thousand Dollars United States Currency (US $100,000) or the equivalent, and/or to debit any account or group of accounts which have been credited a 30–day amount in winnings of more than One Hundred Thousand Dollars United States Currency (US $100,000) or the equivalent. Any parlay, teaser or future bets shall be judged to have been placed during the 30–day period in which the result of the final event in the parlay or future bet(s) was announced. For the purposes of this section, a 30–day period shall be defined as any consecutive 30 days regardless of whether these consecutive 30–days take place in single calendar month or the combination of two or three calendar months.

  18. Withdrawing Funds

    Withdrawal requests can be submitted through our online cashier only, 24 hours a day, 7 days a week. Only allow one (1) payment request per withdrawal method per day, is permitted. Delivery exceptions and restrictions may affect any payment method. In case your request is affected by said restrictions we reserve the right to void the withdrawal request and return funds to the account balance.

    Please check our online cashier or contact our Customer Service Department for a list of our currently available withdrawal methods, limits and restrictions. Please note that we do not process payments as credit/refunds to any type of card. It is also the our right to change the method of payment if necessary and decide whether the withdrawal will be best completed using another of our available options. We reserve the right to issue refunds whenever it deems it necessary.

    We reserve the right to cancel any withdrawal that exceeds the stipulated limits or whenever fraudulent activity has been detected.

    Once approved, withdrawals will be processed only during business days; any international and/or bank holiday may affect the regular payment schedule.

    Your PIN is required to withdraw money from your account. We want financial transactions to be as secure as possible and your PIN number adds a level of security. Your PIN number is randomly generated for your account and is sent to you by e-mail immediately after you create your account.

    You must ensure that your personal details including valid e-mail and postal mailing address are kept up to date on our system. Your postal mailing address on your account must exactly match the address listed on your credit card statements for all credit cards used on your account. We shall not be responsible for any loss, error or claim that may result from your failure to keep such information up to date on our system.

    If you have used their credit/debit/check cards to deposit funds, you must have a complete credit card file (please refer to Your Deposits) in order for their first payment to be approved. All credit/debit/check card users will comply with security and documentation requirements stipulated by the banks and processors. Complete confidentiality on all information provided is ensured by us and enforced by our security protocol.

    We reserve the right to request updated or new documentation whenever it deems it necessary. Payment will under no circumstances be processed and/or approved if such documentation is inaccurate, misleading, incomplete and/or not filed in a timely matter.

    All Withdrawals will be reviewed and processed 48 hrs after they?re requested. During that 48 hr period a pending withdrawal may be cancelled upon your request, free of charge. Please log in through the cashier or contact Customer Service in order to cancel the withdrawal and the funds will be returned to your account.

    If a stop payment order is requested after the 48 hr period expired, it is your sole responsible for the payment of the stop-payment fees (which amount to a minimum of US$52.50). Stop payment fees will be automatically deducted from your account, once the withdrawal amount is refunded to the account balance.

    Claims on withdrawals need to be submitted as soon as possible in order to ensure a proper investigation and prompt response to the claims. We are not obliged to accept nor review claims on withdrawals that are three (3) months or older. We will not be liable, under any circumstances, to pay and/or refund funds, in the event you fail to cash a check payment and the corresponding check expires. Please review our online cashier for more information regarding delivery estimates based on the withdrawal's payment method.

    You are responsible for withdrawing or playing out any funds held in your account. We do not undertake to notify you of outstanding balances. If your account is inactive for longer than 12 months we will charge you an administrative fee equal to your then current account balance and thus you will forfeit any outstanding balance in your account.

  19. Casino Progressive Jackpots

    Winners of any casino progressive jackpot in excess of $25,000 shall be notified by email and shall be required to sign, notarize and return an Affidavit of Eligibility and Publicity Release within five (5) days of notification. This Affidavit must be complete and be attached to a copy of winner's drivers license, passport or national identity card. The information in winner's Affidavit must be correct and must mirror the information provided in winner's original account application form or winner is disqualified. If winner(s) cannot be contacted, is ineligible, fails to claim a prize or fails to return the completed and executed Affidavit as required, or if the prize notification or prize is returned as undeliverable, the prize shall be forfeited.

  20. Taxes

    We will not disclose details of your winnings or losses since this is your responsibility. If you reside in a jurisdiction where your winnings and/or wagers are taxable you must keep track of your winnings and/or wager and report them to the proper authorities. These or any other tax related obligations shall be your sole responsibility and you hereby indemnify us for any liability that we may incur.

  21. Computer Error

    Notwithstanding any implied or express terms of this Agreement, you agree that in the event that our computer hardware or software does not properly implement the rules of a game or does not properly implement the random number generator, or does not make proper account for the play that has occurred, we shall only be liable for your initial deposit, and you shall forfeit any winnings made as a result of the computer or software error.

  22. Terms of the Agreement

    The term of this Agreement will begin upon our acceptance of our membership application and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party notice by electronic mail of termination. You may contact us for this purpose by completing this form. Upon the termination of this Agreement for any reason, you will immediately cease use of our Products and Services.

    In the event that your registration is terminated or suspended, we reserve the right to determine whether to declare as void any of your outstanding bets.

  23. Modification

    We may modify any of the terms and conditions contained in this Agreement at any time and in our sole discretion by posting a change notice or a new agreement on our Sites. IF ANY MODIFICATION IS UNACCEPTABLE TO YOU, YOUR ONLY RECOURSE IS TO TERMINATE THIS AGREEMENT. YOUR CONTINUED USE OF OUR PRODUCTS AND SERVICES FOLLOWING OUR POSTING OF A CHANGE NOTICE OR NEW AGREEMENT ON OUR SITES WILL CONSTITUTE BINDING ACCEPTANCE OF THE CHANGE.

  24. Limitation of Liability

    You understand that gambling involves risk. By wagering on our Sites you run the risk that you may lose money or suffer psychological injuries. You wager at your own risk; we will not be liable for any consequence of your decision to wager or access our Sites.

    We accept no liability for any damages caused to you by the interception or misuse of any information transmitted over the Internet.

    We will not be liable for any consequence alleged to have occurred due to force majeure. For purposes of this Agreement force majeure shall include, but shall not be limited to, failure of our central computer system or any part thereof, delays, losses, errors, or omissions resulting from failure of any telecommunications or any other data transmission system, any act of God, an outbreak of hostilities, riot, civil disturbance, acts of terrorism, acts of Government or authority (including refusal or revocation of any license or consent), fire, explosion, flood, theft, malicious damage, strike, lockout, industrial action of any kind or any other circumstance that was beyond our reasonable control.

    We will not be liable for indirect, special, or consequential damages (or any loss of profits or data) arising in connection with this Agreement or our Product and Services, even if we have been advised of the possibility of such damages. Out total liability in respect to any claim or loss in relation to any single wager you placed will only be the amount you had at risk on that wager. Further, our aggregate liability arising with respect to this Agreement will not exceed the total of your deposits minus your withdrawals from your account.

  25. Disclaimers

    We make no express or implied warranties or representations with respect to our Products and Services (including, without limitation, warranties of fitness, or any implied warranties arising out of a course of performance, dealing, or trade usage). In addition, we make no representation that the operation of our Sites will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors.

  26. Independent Investigation

    YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF USING OUR PRODUCTS AND SERVICES AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE, OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT.

  27. Miscellaneous

    This Agreement shall be governed by the laws of the Netherlands Antilles, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the courts located in the Netherlands Antilles and you consent irrevocably to the jurisdiction of such courts. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and be enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.

  28. Entire Agreement

    The parties agree that this Agreement constitute the complete and exclusive statement of the terms and conditions between you and us covering the performance hereof and cannot be altered, amended or modified except as stated herein.
